1. Acceptance of Terms
By accessing or using SkillSwap Nepal ("the Platform"), you agree to these Terms and Conditions ("Terms"), our Privacy Policy, and any additional guidelines incorporated herein. If you do not agree, do not use the Platform.
2. Eligibility
You must be at least 13 years of age to use the Platform. By registering, you confirm that you are at least 13 years old. Users under 18 must have parental or guardian consent. We reserve the right to verify age and terminate accounts that do not meet this requirement.
3. User Accounts
You are responsible for maintaining the confidentiality of your login credentials. You agree to notify us immediately of any unauthorized access to your account. We are not liable for any loss arising from unauthorized use of your account due to your failure to keep credentials secure.
One person may maintain only one account. Creating multiple accounts to circumvent restrictions or bans is prohibited and will result in permanent termination.
4. User Conduct
You agree not to use the Platform to:
- Post false, misleading, or fraudulent information about your skills
- Harass, bully, or threaten other users
- Solicit payment outside the Platform in violation of our policies
- Distribute spam, malware, or harmful content
- Scrape or systematically extract data without written permission
- Violate any applicable laws or regulations
- Impersonate any person or organisation
- Post content that is unlawful, defamatory, obscene, or violates third-party rights
Violations may result in content removal, account suspension, or permanent ban, at our sole discretion.
5. User-Generated Content
You retain ownership of content you post. By posting, you grant SkillSwap Nepal a non-exclusive, royalty-free, worldwide licence to use, display, reproduce, and distribute your content for operating and promoting the Platform.
You represent that you have the rights to post all content you submit and that it does not infringe any third-party rights.
6. Intellectual Property
The SkillSwap Nepal name, logo, platform design, and all proprietary technology are the exclusive property of SkillSwap Nepal. You may not reproduce, modify, or distribute any part of the Platform without prior written consent.
8. Advertising
SkillSwap Nepal may display advertisements from Google AdSense and other partners. We are not responsible for the content of third-party advertisements. Clicking ads may direct you to external sites governed by their own terms and privacy policies.
9. Disclaimers
The Platform is provided on an "as is" and "as available" basis without warranties of any kind, express or implied. We do not warrant that the Platform will be error-free, uninterrupted, or free of harmful components.
We are not responsible for the quality, accuracy, safety, or legality of skills offered by users. Skill exchanges are conducted between users independently; we are a facilitating platform only.
10. Limitation of Liability
To the fullest extent permitted by law, SkillSwap Nepal shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of, or inability to use, the Platform. Our total liability for any claim shall not exceed NPR 5,000 or the amount you paid us in the preceding 12 months, whichever is greater.
11. Termination
You may delete your account at any time from your settings page. We may suspend or terminate your account for violation of these Terms, illegal activity, or at our discretion with reasonable notice, except where immediate termination is required to protect users or the Platform.
12. Governing Law
These Terms are governed by the laws of Nepal. Any disputes shall be subject to the exclusive jurisdiction of the courts of Kathmandu, Nepal. If any provision of these Terms is found invalid, the remaining provisions remain in full effect.
